RE-City of La Marque and FEMA
The City of La Marque notified the OBIC board via Integrity Property Management on Thursday 05/08/24 of the city’s action concerning a mailout to all property owners concerning the FEMA Flood Damage Prevention Ordinance, and its regulations, violations, and demands required by each property owner.
The city’s mailout is requesting at least two (2) photographs of your ground level enclosure taken from opposite sides of the area to demonstrate that the space is only being used for parking, access, or storage and a copy of your construction elevation certificate if available.
The city and FEMA are hosting a Townhall meeting for the Omega Bay property owners for May 29th at 6:00 at the Fire Station located at 5715 FM 1765, La Marque, TX 77568 to learn more about compliance with the National Flood Insurance Program.
At no time did the city engage with or communicate with the current OBIC board or property management prior to 05/08/24. If you cannot attend the city’s scheduled meeting you may submit your questions to the OBIC board via the email address of Robert Michetich, ram8@swbell.net . We share your same concerns and questions.
The original ordinance of the city on this matter was created in 1979 and repealed and replaced with the current ordinance in 2014. That was recently reviewed by council with no amendments in February of 2024. During the past year, the city has been negotiating with FEMA to lessen the impact on Omega Bay.
Below are some initial concerns and questions that the OBIC will be addressed at the meeting:
1.      Security, safety and privacy of Omega Bay homeowners and residents.
2.      Questions on pictorial documentation of homes with names and addresses falling into the wrong hands.
3.      What protects this documentation from “Open Records Requests” and being sold or distributed.
4.      What stops this documentation from being shared with the appraisal district to raise our taxes.
5.      Is the compliance due to a potential loss of eligibility of disaster funds from FEMA to the entire city?
6.      What are the enforcement actions for non-compliance noted in the letter?
7.      Will homeowners who purchased their homes with the ground level buildout already there, have a grandfather clause?
8.      Does the city and or FEMA intend for the property owner to remove all contents or buildout?
9.      Where are the pictures to be sent?
10.  Are pictures required to be digital?
A staff director from our US House Representative and our State Representative will be in attendance of the May 29th meeting. FEMA will also be present for questions and answers at the meeting.
Note: For an ordinance to be enforceable the actions by the city and all requirements of the property owners must be clearly stated.
